4. Should I continue my HUF under the new tax regime or dissolve it?

Under the New Tax Regime, which is the default from FY 2024-25, most HUF-specific deductions are unavailable: Section 80C, 80D, and standard deduction cannot be claimed unless you opt into the old regime. This changes the tax arithmetic for Gujarati families who set up HUFs primarily for income-splitting. Whether continuing your HUF makes sense depends on whether your family can benefit from other HUF advantages, such as a separate PAN, independent investment accounts, and the ability to pass property through the HUF without attracting gift tax. A SEBI-registered advisor can model both regimes against your specific family income structure before you decide.

5. What are the tax benefits of working in GIFT City IFSC?

Entities registered in GIFT City’s IFSC (International Financial Services Centre — India’s only offshore-equivalent financial zone) receive a 100% income tax deduction under Section 80LA (the IFSC Tax Holiday) for 10 of the first 15 years of operation. These benefits apply to the registered entity, not automatically to individual employees. Employee salary income from an IFSC unit is still taxable under normal slab rates at the individual level. Planning for ESOPs, performance bonuses, and any cross-border income from IFSC structures requires specialist advice. Finnovate works with GIFT City professionals on this combination of entity-level and personal income planning.

6. How can NRIs from Gujarat invest in India without FEMA violations?

NRI funds should flow through NRE (repatriable) or NRO (non-repatriable) accounts, never through a resident savings account after becoming NRI. NRIs can repatriate up to US$1 million per financial year from NRO accounts. Rental income from India can be credited to NRO and repatriated within this limit. FEMA (Foreign Exchange Management Act — India's law governing cross-border money flows for NRIs and residents) violation penalties can reach 3 times the transaction amount. 7. How do I verify that a financial advisor in Ahmedabad is SEBI-registered?

Search the SEBI intermediaries list at sebi.gov.in under Investment Advisers. A registered RIA must follow a fiduciary standard and cannot earn commissions on products they recommend. In Ahmedabad, several large mutual fund distribution networks operate as commission-based advisors; their interests are not legally required to align with yours.
